Student Residence Permit in Turkey
Student residence permits are regulated in Articles 38 to 41 of Law No. 6458 on Foreigners and International Protection. Student residence permits are also regulated in Articles 35 to 39 of the Regulation on the Implementation of the Law on Foreigners and International Protection.
Who are the Foreigners Eligible for a Student Residence Permit?
– Foreigners who will receive primary and secondary education and do not have a family residence permit (Foreigners who will receive primary and secondary education and have a family residence permit can continue their education without needing to obtain a residence permit until the age of 18. However, students who have reached the age of 18 and are still continuing their secondary education must obtain a residence permit).
– Foreigners who will receive education at the associate degree, bachelor’s degree, master’s degree, doctorate, Medical Specialization Education (TUS), or Dental Specialization Education (DUS) levels at a higher education institution in our country,
may be granted a student residence permit.
The student residence permit only entitles the student to support their spouse and children in their family residence permit applications. It does not entitle other relatives to obtain a residence permit.
For how many years can a student residence permit be issued?
If the foreign student’s study period is less than one year, the student residence permit cannot exceed the study period.
Foreigners who come to Turkey to study through public institutions and organizations may be granted a residence permit for the duration of their studies.
Foreigners who will receive primary and secondary education, whose care and expenses are covered by a real or legal person, may be granted and extended a student residence permit for one-year periods during their studies, with the consent of their parents or legal representatives.
What are the conditions for a student residence permit?
In order for a student residence permit to be issued, foreigners must meet the conditions set out in Article 39 of the Law.
-Submit supporting information and documents regarding the purpose of stay in Turkey (Article 38 of the Law),
-Not fall under the scope of Article 7 of the aforementioned Law,
-Provide information about the address where they will stay in Turkey.
What are the reasons for refusal, cancellation, or non-extension of a Student Residence Permit?
– Failure to meet or loss of the conditions required for the issuance of a student residence permit,
– Emergence of evidence that the student cannot continue their studies,
– Determination that the student residence permit is being used for purposes other than those for which it was issued,
– Existence of a valid expulsion decision or entry ban into Turkey,
In such cases, a short-term residence permit will not be issued, if issued it will be canceled, and those that have expired will not be extended.
