1-) Our client has been married to the defendant since …/…/…; on …./…./…, our client filed for divorce, claiming that the marriage had broken down irretrievably. As a result of the ongoing proceedings, the … Family Court, in its decision numbered …./…. E. …./…. K., ruled that the parties should live separately for a period of … years.
2-) The parties had previously agreed to a community property regime, but since it is not possible to apply the rules of this regime during the …-year separation period granted by the court, they request that the said property regime be lifted during the separation period. With this petition, we request that the said property regime be lifted.
