SUBJECT : Our petition contains our request for eviction due to unlawful occupation.
OUR EXPLANATIONS
1- The defendant is residing as a tenant in the apartment located at the address of …, which is owned by our client, the plaintiff, under a written lease agreement dated …/…/… with a monthly rent of … TL.
2- Despite the condition in the lease agreement that the leased property cannot be transferred to another party, the defendant subleased the property to … on …/…/….
3- Upon this situation, the plaintiff’s client notified the defendant by a letter of formal notice dated …/…/… and numbered … from the …… Notary Public that he did not consent to this and that the leased property should be restored to its original state within one month.
4- However, since the defendant did not restore the leased property to its original state despite this letter of formal notice, it became necessary to file this lawsuit.
LEGAL GROUNDS: Law No. 6570, Article 12 and other relevant legislation.
LEGAL EVIDENCE: Lease agreement dated …/…/…, witness statements, formal notice, expert examination, legal and discretionary evidence.
CONCLUSION AND REQUEST: For the reasons explained above, we respectfully request that the defendant be evicted from the leased property and that the defendant be ordered to pay the costs of the proceedings.
