SUBJECT : This is to submit our petition requesting the removal of the guardianship.
OUR EXPLANATIONS
1-) In the file numbered …/…/… T. …/… E. …/… K. of the … Civil Court of Peace, … … had a relationship without marriage, and on …/…/…, the minor … … was born. In the paternity case to be opened regarding this, it was requested that a guardian be appointed for the minor … … on the grounds that the interests of … … and the minor … … would conflict. As a result of this case, our client … … was appointed as guardian.
2-) The aforementioned paternity case was filed on …/…/… in the … Court, file no. …/… E. …/… K., and this case was decided on …/…/… and became final on …/…/….
3-) Article 447 of the Turkish Civil Code No. 4721;
“Representative guardianship ends with the completion of the task assigned to the guardian.
Administrative guardianship ends with the disappearance of the reason requiring the appointment of the guardian or with the removal of the guardian from office. Legal counsel ends with the decision of the guardianship authority in accordance with the provisions relating to the removal of guardianship.”
Within the framework of this provision, the task undertaken by our client as part of his guardianship duties has ended due to the paternity case being filed and finalized.
