Enforcement and Bankruptcy Offenses – Failure to Deliver the Requested Property, Failure to Be Present During Bookkeeping, Failure to Comply with the Orders of the Bankruptcy Administration
Article 337/2 “Those who violate the provisions of Articles 162, 209, and 216 shall also be subject to the same penalty upon the issuance of a memorandum by the bankruptcy administration. If the obligations specified in these articles are fulfilled, the penalty for enforcement offenses shall be waived.”
As stated above, the first paragraph of the article has been annulled by the Constitutional Court’s decision, but since there is no annulment decision regarding the second paragraph, the enforcement offenses remain in force. As clearly stated in the text of the article, the penalty to be imposed shall be waived if the specified obligations are fulfilled.
