SUBJECT OF THE CASE :

It consists of the request for the termination of the lease agreement and the evacuation of the leased premises due to the fact that the leased premises has been rented by the tenant to a third party.

FACTS :

1- The defendant Tenant K is residing as a tenant in the flat owned by my client Lessor …. and located at the address ………, ………. district ………….. in ……… as a tenant in accordance with the lease agreement dated …………. and still pays monthly rent ……..

2- In the last article of the lease agreement between the defendant tenant ……. and my client; “during the continuation of the lease agreement, the tenant cannot rent the leased property to a third party, otherwise this will be a reason for eviction”.

3- Despite this, the main tenant defendant Tenant ….. rented the leased property belonging to my client to a third party, the other defendant sub-tenant ……, and he himself completely moved out of the apartment in question and settled in his own house.

4- This situation is clearly contrary to the lease agreement, as well as contrary to the prohibition of sublease regulated in article ………. In order to eliminate the contradiction in question, my client served a notice to the defendant with the notice of ……… date and …….. journal number of ……… Notary of ……… Notary and notified that “he acted contrary to the provisions of the lease agreement by renting the leased property to a third party and if he does not end this situation within … days, the lease agreement will be terminated and an eviction lawsuit will be filed against him”, but no result has been obtained and the lease agreement between the original tenant and the other defendant has not been terminated.

5- In this respect, it has become necessary to file this lawsuit in order to decide on the termination of the lease agreement and the eviction of the defendant due to the violation of both the explicit provisions of the contract and the prohibition of sublease regulated in article ……… by renting the leased property to a third party.

For the above-mentioned reasons, with the acceptance of our lawsuit, I request that the lease agreement be terminated due to the fact that the defendant, who is the tenant in the leased property belonging to my client in accordance with the lease agreement dated ……., has rented the leased property to a third party in violation of the provisions of the contract and the prohibition of sublease regulated in the article ………, and that the defendant be evicted from the leased property and that the trial costs and attorney fees be left on the defendants.
