
- If the lessee fails to fulfil the obligation to pay the rent or ancillary expenses due after the delivery of the leased property, the lessor may notify the lessee in writing that he will terminate the contract in case of non-performance within this period. The period to be given to the lessee is at least ten days, and at least thirty days for residential and roofed workplace leases. This period starts to run from the day following the date of written notification to the lessee.
- The lessee is obliged to pay the rent and, if necessary, the ancillary expenses at the end of each month and at the latest at the end of the lease term, unless there is a contract or local custom to the contrary. The lessee’s breach of these obligations allows the lessor to terminate the agreement. For this purpose, the lessee must be notified in writing and given at least thirty days to make payment.
- The lawsuit is filed in the Civil Court of Peace in accordance with the Civil Procedure Law. The jurisdiction is in the court where the immovable property is located.
- The necessary evacuation procedures will be initiated in the enforcement office by way of forced execution of the decision given as a result of the evacuation lawsuit filed due to default
