Family Residence Permit in Turkey

Family residence permits are regulated in Articles 34 to 37 of Law No. 6458 on Foreigners and International Protection. Family residence permits are also regulated in Articles 30 to 34 of the Regulation on the Implementation of the Law on Foreigners and International Protection.

Who are the Foreigners Eligible for a Family Residence Permit?
Family residence permits may be issued to Turkish citizens, persons covered by Article 28 of Law No. 5901, or foreigners who hold one of the residence permits, as well as refugees and persons with subsidiary protection status, for:

a) Their foreign spouse,
b) Their own or their spouse’s minor foreign child,
c) Their own or their spouse’s dependent foreign child.

If the foreigner applying for a family residence permit has more than one spouse, a family residence permit may be issued to only one of the spouses. However, a family residence permit may be granted to all of the foreigner’s children.

In cases where children apply for a family residence permit, the consent of the mother or father with joint custody outside of our country must be obtained.

A family residence permit grants the right to education in primary and secondary education institutions until the age of eighteen without obtaining a student residence permit.
For How Many Years Can a Family Residence Permit Be Issued?

-A family residence permit can be issued for a maximum of three years at a time.
-The duration of the family residence permit cannot exceed the duration of the sponsor’s residence permit under any circumstances.

What are the conditions for a family residence permit?

In order for a family residence permit to be issued, foreigners must meet the conditions set out in Article 35 of the Law.

– Meet the conditions required of the sponsor,
(The sponsor must have valid health insurance covering all family members, a monthly income of at least one-third of the minimum wage per person, a criminal record certifying that they have not committed any crimes against the family order in the last five years, have resided in Turkey for at least one year, and be registered in the address registration system).
– Meet the requirements for those applying for a family residence permit to stay with the sponsor,
(Submitting information and documents related to the sponsor for the purpose of staying in our country, proving that they live or intend to live with the specified persons, spouses must be over eighteen years of age, not falling under the scope of Article 7 of the aforementioned Law, the marriage must not have been made for the purpose of obtaining a family residence permit)

What are the reasons for the rejection, cancellation, or non-extension of a family residence permit?

– Failure to meet or loss of the conditions required for a family residence permit,
– Determination that the family residence permit is being used for purposes other than those for which it was granted,
– Existence of a valid decision to expel the person from the country or prohibit their entry into the country.
In such cases, a family residence permit will not be granted, will be revoked if already granted, and will not be extended when it expires.
