Humanitarian Residence Permit in Turkey

Humanitarian residence permits are regulated in Articles 46 and 47 of Law No. 6458 on Foreigners and International Protection. Humanitarian residence permits are also regulated in Article 44 of the Regulation on the Implementation of the Law on Foreigners and International Protection.

Who are the Foreigners Eligible for a Humanitarian Residence Permit?

– When it is in the best interests of the child,

– When foreigners cannot be forced to leave Turkey despite a decision to deport them or ban them from entering Turkey, or when it is not reasonable or possible for them to leave Turkey,

– When no decision to deport the foreigner has been made in accordance with Article 55 of the Law,

– When judicial recourse is sought against the procedures carried out in accordance with Articles 53, 72, and 77 of the Law,

– During the continuation of the procedures for returning the applicant to their first country of asylum or a safe third country,

– When foreigners who must be allowed to enter and remain in Turkey for urgent reasons or for the protection of national interests and public order and security cannot obtain any other residence permit due to circumstances preventing them from being granted a residence permit,

– In extraordinary circumstances,

a humanitarian residence permit may be issued.

For how many years can a humanitarian residence permit be issued?

Humanitarian residence permits are issued and extended by the governor’s office, subject to the approval of the Ministry and for a maximum period of one year.

What are the conditions for a humanitarian residence permit?

The conditions for granting other residence permits do not apply to humanitarian residence permits.

What are the reasons for refusal, cancellation, or non-extension of a humanitarian residence permit?

Humanitarian residence permits are canceled by the governor’s office and not extended when the conditions requiring the permit to be granted cease to exist, subject to the approval of the Ministry.
