SUBJECT: This petition contains our request for a precautionary decision regarding the child pursuant to Article 7 of Law No. 5395.
OUR EXPLANATIONS
1-) Our client …. ….. has a daughter named …… ….. born on …/…/…. in ……. In file no. …./… E. concerning our client’s daughter, it was decided that there were no grounds for prosecution because the minor had not reached the age of 12 at the time of the offense.
2-) The client’s spouse passed away during the birth of their children. Therefore, the child grew up deprived of maternal love and affection. The client has tried to be resilient in his struggle against life and is trying to provide for all of his child’s needs himself. However, he is struggling greatly to meet both the household needs and his child’s care and expenses on his own.
He wants his child to complete his education and have a good profession, but he believes that he cannot afford this within his means. The fact that the child is only 12 years old, that the neighborhood they are forced to live in due to economic circumstances is considered “dangerous,” that drug dealers and prostitution are widespread, and that the level of education is significantly lower than in other neighborhoods naturally causes the client to worry about her child and his future. The increasingly difficult economic conditions have also led the client to consider taking some radical decisions regarding the child.
3-) As defined in the Child Protection Law, the minor is a child driven to crime. Until our client overcomes his financial difficulties, it is necessary to obtain a protection order for the minor in order to ensure that he receives good care and a good education, that his care expenses are covered, and that he is placed in a boarding school or a shelter if necessary.
