Determination Of The Degree Of Disability By The SGK Health Board
The Social Security Institution (SGK) Health Board determines the degree of disability, and disability benefits are granted based on this decision. Upon the request of the SSK member, the SGK-authorized hospitals’ health boards examine the reports prepared in accordance with the procedures and the supporting medical information. If the SGK Health Board determines that the insured has lost at least 60% of their working capacity, they are considered disabled, retired on disability, and granted a monthly pension.
It is often observed that the degree of disability in the report obtained from the medical board of the referred hospital is reduced by the SGK Medical Board. Indeed, if your report degree has been reduced and you have not been retired on disability, you can exercise your right to appeal against the SGK Medical Board’s report. If your appeal is unsuccessful and your disability rating is not changed and you are not retired, you can file a lawsuit with the Labor Court. Based on the report you will receive from the hospital appointed by the court, the court will decide on your disability rating. If the court decides that you have suffered a loss of working capacity of 60% or more, you can retire on disability.
