Parties to the lease agreement
There are two parties to the lease agreement: the lessor and the lessee.
Lessor: The person who transfers the right to use and enjoy the immovable property to the lessee in exchange for a fee.
Lessees: The person who uses and enjoys the property for a temporary period in exchange for a specific fee.
The parties have certain obligations to each other arising from the lease.
Obligations of the lessor
1-Obligation to deliver TBK 301 (818 SK 249/1)
2-Obligation to bear taxes and similar obligations TBK 302 (818 SK 258/1)
3-Obligation to bear incidental expenses: Turkish Code of Obligations (TBK) 303 (818 SK 258/2)
4-Liability for defects in the leased property at the time of delivery: Turkish Code of Obligations (TBK) 304 (818 SK 249/1-3)
5-Liability for defects that arise in the leased property after delivery: Turkish Code of Obligations (TBK) 305 (818 SK 249/1-3)
If there are defects, the tenant may terminate the contract or request a reduction in the rent. (Articles 306 and 307 of the Turkish Code of Obligations)

TENANT’S OBLIGATIONS
1-Obligation to pay rent (Turkish Civil Code Article 313)
2-Obligation to use the leased property with care and show respect to neighbors (Turkish Civil Code Article 316 (818 SK 256))
3-Obligation to pay cleaning and maintenance expenses (Turkish Civil Code Article 317 (818 SK 258/II))
4-Obligation to notify the lessor of defects, Turkish Code of Obligations Article 318 (818 SK 356/final)
5-Obligation to tolerate the repair of defects and the inspection of the leased property, Turkish Code of Obligations Article 319 (818 SK 251/1)
