Petition For Cancellation Of Real Estate Registration Due To Expiration Of Statute Of Limitations
COURT OF
PLAINTIFF :
ATTORNEY :
DEFENDANT :
SUBJECT : Request for Cancellation of Title Deed and Registration.
EXPLANATIONS:
1-) The immovable property registered under the number … Ada, ……… Parsel, was sold to the defendant by his father, who signed as his guardian, on the grounds that my client was not of legal age.
2-) Thus, the aforementioned immovable property was registered in the name of the defendant, but ten years have not passed since then. However, my client was born on …/…./…, and was of legal age on …/…/…, the date of the title deed transaction. Therefore, it is not legal for his father to sell on behalf of my client.
3-) For this reason, it has become necessary to file a lawsuit for the cancellation of the title deed registration of the immovable property registered in the name of the defendant and for it to be registered in the name of the plaintiff.
LEGAL GROUNDS: Law No. 4721, Article 712 and related legislation.
LEGAL EVIDENCE: Land registry record, population registry, witness statements, and other evidence.
CONCLUSION AND REQUEST: For the reasons explained above, I respectfully request that Your Honorable Court rule to cancel the registration of the immovable property registered in the name of the defendant in the land registry under the number … Ada, ……… Parsel, register and certify it in the name of the plaintiff, and charge the defendant with the costs of the proceedings. …/…/…
