SUBJECT : Our request for eviction due to the tenant’s default.
EXPLANATIONS : 1- The defendant tenant resides as a tenant in the apartment belonging to the client and located at the address of …, pursuant to the lease agreement dated …/…/…, and currently pays a monthly rent of … TL.
2- The lease agreement between the defendant and the client stipulates that rent payments shall be deposited into the account at ……….. Bank ……. Branch between the …th and …th days of each month. However, since the defendant failed to deposit the rent for the month of … of the year … into the relevant account on the dates specified in the agreement, a warning letter was sent to the defendant via the Notary Public on …/…/… regarding the payment of the overdue rent. A formal notice was sent to the defendant via the Notary Public on …/…/…, stating that if the rent was not paid within 30 days of the date of service of the notice, the defendant would be deemed to be in default in accordance with the Law of Obligations and an eviction lawsuit would be filed against them. Despite this, the defendant has not paid the rent in question.
3- Therefore, since the tenant has defaulted by failing to pay the rent of … TL, it has become necessary to file this eviction lawsuit.
LEGAL GROUNDS: The Code of Obligations, the Code of Civil Procedure, and other relevant legislation.
LEGAL EVIDENCE: The lease agreement dated …/…/…, the notice of default dated …/…/… drawn up through the … Notary Public, land registry records, witness statements, and any other legal evidence as necessary.
CONCLUSION AND REQUEST: For the reasons explained above, we respectfully request and demand that the defendant be evicted from the leased property where he resides as a tenant, that the unpaid rent of TL be collected, and that the costs of the proceedings be borne by the defendant.
