
Resisting The Enforcement Of Court Judgments
For the offense of resisting the enforcement of a court judgment to be established, there must be a final court decision, and this decision must meet the conditions specified in the text of the law. The scope of the decision, as specified in the statute, pertains solely to the performance or non-performance of an act to be carried out by the debtor, or the establishment or termination of an easement. A debtor who fails to comply with this comprehensive decision without just cause shall be punished in accordance with the provisions of this article.
The offense of resisting the enforcement of a court judgment is subject to a complaint, which must be filed within three months from the date the offense was committed.
The court responsible for hearing the case is the Enforcement Criminal Court; the competent court is either the local court where the enforcement office conducting the proceedings is located or the local court where the offense was committed.
